Work out the dates of Statutory Adoption Leave: the window the leave has to open in, the notice deadlines, and the day the employee is due back at work. UK and overseas adoptions.
An overseas adoption runs on the arrival in the UK rather than on a placement date, and the notice period is longer.
The matching date starts the clock: the employee has 7 days from it to tell you how much leave they want and when.
The date the child starts living with them. Leave can open up to 14 days before it.
Adoption leave runs
Two quick steps: where the child is coming from and the two dates that matter, then when the leave opens. Adoption leave is a day-one right and runs for the same 52 weeks as maternity leave. The dates appear here as a step by step timeline.
Adoption leave and pay, tracked together
Moonworkers holds the leave dates against the employee, opens the 39 weeks of pay on the right payrun, keeps the recovery on the EPS and stops the leave when the employee comes back.
There is no due date to count back from, so everything hangs off the match and the day the child actually arrives.
Step 1
A UK adoption starts its notice clock on the matching date, and the employee has 7 days to tell the employer. An overseas adoption starts on the official notification, and the window is 28 days.
Step 2
UK adoptions can open the leave up to 14 days before the placement. Overseas adoptions cannot open it before the child lands, and have 28 days from then to get it started.
Step 3
26 weeks of ordinary leave, then 26 weeks of additional leave, then back to work the next day. Statutory Adoption Pay covers only the first 39 of those weeks.
See also the maternity leave calculator and the paternity leave calculator, which the second adopter will need.
52 weeks, exactly like maternity leave. The first 26 weeks are Ordinary Adoption Leave and the last 26 weeks are Additional Adoption Leave. The employee does not have to take all of it.
For a UK adoption, on the date the child starts living with the employee, or on a chosen date up to 14 days before it. For an overseas adoption, on the date the child arrives in the UK, or within the 28 days that follow.
Yes, for employees. There is no length of service test for the leave. Statutory Adoption Pay is different: that needs 26 weeks of continuous employment by the end of the matching week, plus average weekly earnings at or above the Lower Earnings Limit.
For a UK adoption, within 7 days of being matched they tell the employer how much leave they want, when it starts, and the date of placement. For an overseas adoption, within 28 days of the official notification. The employer then has 28 days to confirm the dates in writing.
No. Only one person in a couple takes adoption leave, and the couple decide which one. The other can take paternity leave, and they can then share the rest through Shared Parental Leave if they both qualify.
The employee tells the employer as soon as reasonably practicable, and gives 28 days’ notice of the new start date where they can. The leave still runs for 52 weeks from whatever date it actually opens on.
Yes, for parents who have applied for a parental order. Their leave starts on the day the child is born or the day after, rather than on a placement date, and the rest of the 52 weeks works the same way.
The main adopter can take paid time off for up to 5 adoption appointments once they have been matched. The other adopter can take unpaid time off for up to 2. This sits on top of the leave itself.
